WhatsApp User Data Gets Delhi HC Approval For FB Sharing

WhatsApp user data has got Delhi HC’s permission to allow data sharing on Facebook. However, there are certain limitations to that. Read on to know more.

According to the new privacy policy issued by WhatsApp user data can now be shared along with the user’s phone number, with Facebook. In order to enable that, WhatsApp appealed to Delhi High Court, which instantly gave its approval for the same. But, it also laid some ground rules for WhatsApp, before the official implementation of the policy.

As per the new rules laid by the court, any WhatsApp user data generated prior to September 25, cannot be shared on Facebook. The messaging firm has also been informed to remove all user data of anyone who deletes his/her WhatsApp account before this date, entirely from the servers. Chief Justice G. Rohini and Justice Sangita Dhingra Sehgal have permitted the messaging app to follow these new policies for the moment; while the issue awaits the decision from the Supreme Court.

On giving its approval for the new privacy policy, while the case is pending in the Supreme Court, the High Court Bench says,

“Having regard to the complete security and protection of privacy provided by WhatsApp initially while launching WhatsApp and keeping in view that the issue relating to the existence of an individual’s right of privacy as a distinct basis of a cause of action is yet to be decided by a larger bench of Supreme Court, we consider it appropriate to issue the following directions to protect interest of users of WhatsApp”.

This statement by the HC is an indication towards the sea changes in the privacy policy, that was brought about as a result of Facebook’s acquisition of WhatsApp back in 2014.

It’s not just the new privacy policy regarding WhatsApp user data sharing that the High Court has looked into. It has also taken the matter of regulation of chat apps into its hands. For the same, it has asked Telecom Regulatory Authority of India (TRAI), as well as the government to take necessary measures.

What changes this new privacy policy will bring in WhatsApp user data and in the lives of its users? We’ll get to see in the days to come. For now, we have to see whether this policy will get the approval from the Supreme Court or not!
